1. Definitions

"Aethervoy," "we," "us," or "our" refers to Aethervoy, a sailing services provider operating from Petaling Jaya, Malaysia.

"Guest," "you," or "your" refers to individuals who book or participate in our sailing services.

"Services" refers to all sailing journeys, charter services, and related activities provided by Aethervoy.

"Vessel" refers to the yacht, boat, or sailing craft used for your journey.

"Agreement" refers to these Terms & Conditions along with your booking confirmation.

2. Acceptance of Terms

By booking a sailing journey with Aethervoy, submitting an inquiry through our website, or participating in our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our services.

You must be at least 18 years old to book services. If booking for minors, you represent that you have legal authority to do so and that you accept full responsibility for their participation and safety during the journey.

3. Services Description

Aethervoy provides sailing journey services in the Andaman Sea, including day trips, multi-day island journeys, and cross-border passages between Thailand and Malaysia. Services include vessel charter with experienced crew, meals, safety equipment, and voyage coordination.

Journey descriptions on our website represent typical itineraries. Actual routes, stops, and activities may vary based on weather conditions, sea state, safety considerations, and operational factors. We retain the right to modify itineraries as necessary to ensure guest safety and service quality.

4. Booking Process

4.1 Reservation

Bookings are made through direct contact with Aethervoy via phone, email, or our website contact form. A booking is considered confirmed when you receive written confirmation from us and required deposits have been paid.

4.2 Deposit and Payment

A deposit of 50% of the total journey cost is required to confirm your booking. Full payment is due 30 days before your scheduled departure date for multi-day journeys, or 7 days before for sunset cruises. Payments can be made via bank transfer or other methods as communicated during booking.

4.3 Pricing

Prices are quoted in Malaysian Ringgit (MYR) and are subject to change until your booking is confirmed. Once confirmed, your price is guaranteed. Prices include vessel charter, crew, meals as specified, safety equipment, and activities listed in your journey description. Prices do not include personal expenses, alcoholic beverages unless specified, or travel to and from the departure point.

5. Cancellation and Refunds

5.1 Guest Cancellation

Cancellations are subject to the following terms:

  • • More than 60 days before departure: Full refund minus 10% administrative fee
  • • 30-60 days before departure: 50% refund
  • • 15-29 days before departure: 25% refund
  • • Less than 15 days before departure: No refund

5.2 Aethervoy Cancellation

We reserve the right to cancel journeys due to weather conditions, safety concerns, insufficient bookings, or circumstances beyond our control. In such cases, we will offer alternative dates or a full refund. We are not responsible for any additional costs you may incur as a result of cancellation, including travel arrangements or accommodation bookings.

5.3 Weather and Force Majeure

If weather conditions make sailing unsafe or inadvisable, we may postpone or modify your journey. We will work with you to reschedule at no additional cost, or provide a refund if rescheduling is not possible. Events beyond our reasonable control, including natural disasters, political instability, or public health emergencies, constitute force majeure and release us from contractual obligations without liability for refunds.

6. Guest Responsibilities

6.1 Information Accuracy

You must provide accurate information during booking, including any medical conditions, dietary requirements, or physical limitations that may affect your participation. Failure to disclose relevant information may result in denied boarding or termination of services without refund.

6.2 Safety Compliance

Guests must follow all safety instructions provided by crew members, wear safety equipment when required, and behave in a manner that does not endanger themselves or others. The captain has final authority on all safety matters and decisions made for safety reasons are binding.

6.3 Conduct

Guests are expected to behave respectfully toward crew members, other guests, local communities we visit, and the marine environment. We reserve the right to remove any guest whose behavior is disruptive, threatening, or violates Malaysian or Thai laws, without refund.

6.4 Documentation

For cross-border journeys, guests are responsible for holding valid passports and any required visas. While we assist with border formalities, you are ultimately responsible for meeting all legal requirements for international travel.

7. Liability Limitations

7.1 Maritime Activities Disclaimer

Sailing and maritime activities involve inherent risks. While we maintain high safety standards and employ experienced crew, we cannot guarantee that journeys will be free from accidents, injuries, or unforeseen events. Guests participate at their own risk.

7.2 Services Provided "As Is"

Our services are provided as described, but we make no warranties regarding specific weather conditions, marine life sightings, or other natural phenomena. We strive to deliver quality experiences but cannot control all environmental factors.

7.3 Maximum Liability

To the maximum extent permitted by Malaysian law, our total liability for any claims arising from your journey is limited to the amount you paid for services. We are not liable for indirect, consequential, or punitive damages.

7.4 Personal Property

We are not responsible for loss, damage, or theft of personal belongings during your journey. Guests should secure valuables and maintain appropriate insurance for personal property.

8. Insurance

Aethervoy maintains maritime liability insurance as required by Malaysian regulations. However, this does not cover personal injuries, medical expenses, or travel disruptions for guests.

We strongly recommend that all guests obtain comprehensive travel insurance covering medical emergencies, trip cancellation, personal belongings, and maritime activities. Proof of insurance may be required for certain journeys.

9. Medical Considerations

Sailing can be physically demanding and may not be suitable for individuals with certain medical conditions. Guests should consult healthcare providers before booking if they have concerns about their ability to participate.

Crew members are trained in basic first aid, but we are not medical professionals. In case of medical emergencies, we will seek appropriate medical assistance, but guests are responsible for all medical costs incurred. Our vessels carry first aid equipment and emergency communication devices, but access to advanced medical care may be delayed while at sea.

10. Intellectual Property

All content on our website, including text, images, logos, and voyage descriptions, is owned by Aethervoy and protected by Malaysian and international intellectual property laws. You may not reproduce, distribute, or use our content for commercial purposes without written permission.

Guests may take photographs and videos during journeys for personal use. We may photograph or film voyages for promotional purposes. If you prefer not to be included in such materials, please inform crew at the start of your journey.

11. Privacy

Your personal data is handled according to our Privacy Policy. By using our services, you consent to data collection and processing as described in that policy. Please review our Privacy Policy for detailed information about data practices.

12. Dispute Resolution

12.1 Informal Resolution

If you have concerns about our services, please contact us directly. We are committed to addressing issues promptly and fairly through good-faith discussions.

12.2 Formal Disputes

Any disputes that cannot be resolved informally will be governed by Malaysian law and subject to the exclusive jurisdiction of Malaysian courts. The venue for any legal proceedings shall be the courts of Selangor, Malaysia.

13. Modification of Terms

We may update these Terms & Conditions periodically. Changes will be posted on our website with an updated "Last Modified" date. Continued use of our services after changes constitutes acceptance of revised terms. For bookings already confirmed, the terms in effect at the time of confirmation will apply.

14. Severability

If any provision of these Terms & Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms & Conditions, together with your booking confirmation and our Privacy Policy, constitute the entire agreement between you and Aethervoy regarding use of our services. They supersede all prior communications, proposals, and representations, whether oral or written.
